The co-hosts of “The View” recently proposed an amendment to the Constitution that would prevent former President Donald Trump from serving a possible second term in prison should he be convicted of the 37 criminal charges brought against him.
However, the suggestion to change the Constitution was misguided. While the former president may potentially face criminal charges, any suggestion of amending the Constitution to suit the case of one individual is a slippery slope that does not serve the interests of justice. Altering the Constitution to address a single case not only sets a dangerous precedent but is contrary to the rule of law.
Additionally, amending the Constitution should not be taken lightly or used as a political tool. The Constitution works because of the checks and balances implemented by the several branches of government. Any changes to the Constitution should be thoughtful and created only to ensure a better future for all citizens.
Furthermore, the charges brought against President Trump are certainly unsettling. But small compared to the known crimes of others currently in office. President Joe Biden and his son Hunter are also under investigation by the FBI regarding a $5 million bribery scheme connected to a Ukrainian oligarch. The investigation is ongoing, yet no one is pushing for an amendment to the Constitution so that the Bidens will not be able to serve in public office if convicted.
In other words, the suggestion of changing the Constitution to stop an individual from taking office is an unnecessary and illegitimate solution. It would be both undemocratic and unconstitutional to deny an individual the right to serve if they are running for office again.
Ultimately, the Constitution was drafted to uphold the sacred right to trial by jury and to protect the rights of all citizens equally. By changing the Constitution for the sake of one individual, we would be undermining the freedoms that it was intended to preserve. Abandoning the Constitution for the sake of a negative narrative against one individual would rob us of the very freedoms we so strongly prize.
I hate to point out the irony here, but most of America’s founding fathers would have been considered criminals by the crown. In a truly Democratic system where voters’ voices count, it should be their choice.
Think of Nelson Mandela, who spent 27 years in prison for trying allegedly to overthrow the government in South Africa, where he would later be elected as President. According to the co-hosts, the people of South Africa shouldn’t have been given the choice to elect him.
No matter where you land in this whole mess I think we can all agree that we need is a justice system that works the same for everyone, regardless of their affiliations or social/political status.

I do not expect President Trump will be convicted, however, worst case scenario, if he is, I don’t believe he will be sentenced to prison. If you believe President Trump will go to jail, the solution is simple, no Constitutional amendment required, DON”T VOTE FOR HIM.
