During a hearing on Tuesday, former Special Counsel Robert Hur testified before the House Judiciary Committee about his report on the investigation into Joe Biden’s handling of classified documents while he was vice president in the Obama administration.
Many Republicans raised concerns about discrepancies between Hur’s investigation and the one conducted by Special Counsel Jack Smith into former President Donald Trump’s handling of classified information. While Smith ultimately decided to file charges against Trump, Hur chose not to pursue any charges against Biden.
Representatives at the hearing questioned Hur as to why he did not press charges against Biden, despite finding evidence that he had willfully retained classified materials after his time as vice president. Hur defended his decision, stating that he applies the same standards and impartiality regardless of the individual or administration.
However, during the hearing, California Republican Rep. Darrell Issa challenged Hur, asking him if he believed that Biden was “outright innocent.” Hur was forced to admit that this was not reflected in his report. He also clarified that he did not exonerate Biden, something he further emphasized when interrupted later by Washington Democrat Rep. Pramila Jayapal.
Florida GOP Rep. Matt Gaetz boldly questioned the special counsel, referencing a statement made by Biden on Feb. 8 where he declared, “I did not share classified information. I did not share it. I guarantee I did not.” Gaetz then asked Hur directly, “That’s not true, is it, Mr. Hur?” The investigator, caught off guard and unable to hide his amusement, responded with a simple, “Yeah.”
In another line of questioning, Gaetz brought up the case of ghostwriter Mark Zwonitzer, who allegedly deleted audio recordings of Biden discussing classified documents during their work on his memoir.

Gaetz asked Hur what someone would have to do to be charged with obstruction of justice, pointing out that Zwonitzer was not charged despite deleting evidence. Hur attempted to justify this by stating that Zwonitzer had kept transcripts of the recordings, to which Gaetz retorted, “So if you destroy some evidence but not other evidence that somehow absolves you of the evidence you destroy.”
It was clear that Gaetz was pointing out the hypocrisy in Hur’s decisions, and he summed it up perfectly when he stated, “Like, here’s what I see, [Hur]. Zwonitzer should have been charged, wasn’t. Biden and Trump should have been treated equally. They weren’t. And that is the double standard that I think a lot of Americans are concerned about.”
Hur’s actions in the of Biden’s mishandling of classified documents show a clear bias and favoritism towards a sitting president. By not following the precedent set by Smith’s investigation of Trump, Hur created a perception of a biased justice system. As Gaetz pointed out, it is this double standard that is concerning to many Americans. The lies and cover-up attempts by Biden and those involved only add fuel to the fire and continue to erode trust in our justice system.

Biden’s actions were perpetrated when he was NOT aged and senile. To absolve him of guilt is the same as catching a murderer that committed his crimes in his youth but now is in his dotage. Is he now innocent? Biden is guilty as Hell, so was Clinton. Both walked due to Democrat control of investigation. They also control Trump investigation. His actions are less problematic than Biden or Clinton. His records were in a locked room on a guarded estate. Biden’s Dept of Justice shows no justice!
Hur has done America a tremendous disservice. He has reinforced the two tier justice system that we fear.
