Federal Judge Invalidates Grand Jury Subpoenas Targeting Tim Walz and Jacob Frey

Judge Throws Out the Subpoenas

A federal judge has quashed grand jury subpoenas that were issued to Minnesota Governor Tim Walz, Minneapolis Mayor Jacob Frey, Attorney General Keith Ellison, and other state and local officials. U.S. District Judge Patrick Schiltz, a George W. Bush appointee, said the subpoenas were retaliatory, which is a polite legal way of saying the government cannot act like a scolded teenager and use its power to get even. The fight grew out of a Justice Department investigation into whether top Minnesota officials interfered with ICE operations while publicly attacking federal immigration enforcement.

Why the DOJ Opened the Probe

The Justice Department issued the subpoenas in January as part of a criminal investigation tied to public comments and actions by Walz, Frey, and others. According to the reporting, the inquiry centered on statements made by the officials as federal agents carried out immigration enforcement in Minneapolis and across Minnesota. Thousands of federal agents were deployed to Minneapolis earlier this year to arrest illegal alien criminals, and that move set off a firestorm among state Democrats who have spent years defending sanctuary-style policies. That is the same old script: let the border chaos build, then act offended when Washington decides to enforce the law.

Walz and Frey Took Aim at ICE

Walz and Frey both blasted the Trump administration for sending ICE agents into Minnesota, and Frey went even further. He demanded that residents and local police fight ICE agents in the street, a remark that should have set off alarms for anyone who still believes public officials ought to calm tensions instead of pouring gasoline on them. The Justice Department later issued subpoenas to six Minnesota officials as part of the case, but Judge Schiltz said the subpoenas could not stand after reviewing the circumstances. In his ruling, he pointed to the administration’s attacks on sanctuary jurisdictions and its broader push to pressure cities and states that refuse to fully cooperate with federal immigration authorities.

What the Judge Said About the Political Fight

Schiltz wrote that President Trump and members of his administration have repeatedly targeted sanctuary jurisdictions, including places that limit the use of local resources to help federal immigration enforcement. He also noted Trump’s repeated criticism of Minnesota and its Somali population, his targeting of Democratic-led cities for expanded deportation efforts, and his warnings that officials who oppose National Guard deployments for immigration work could face jail. The ruling does not end the larger political battle over immigration enforcement, but it does block one round of subpoenas that had put Minnesota’s top officials squarely in the spotlight. For voters watching this mess, the lesson is simple: when politicians spend years cheering lawless sanctuary policies, sooner or later the federal government comes knocking.
